Arbitration court of the Czech Republic - Arbitrážní soud České republiky, o.s.

Nowadays, arbitration is more and more popular mean of disputes resolution. Arbitration is one of so called alternative dispute resolution procedures. Its fundamental is an agreement between parties to a (potential) dispute that all their legal discrepancies shall be resolved by an arbitrator appointed by the parties, instead of general courts.

Arbitrator can be any person appointed by the parties – the only requirement is just legal capacity of such person. Newertheless, it is recommended to appoint as an arbitrator such person who has also necessary legal education and experience with disputes resolution.

Arbitration proceeding in particular case shall be governed by rules agreed by the parties. As such rules should be set quite detaily and exactly, it is recommended to take advantage of rules set down by an expert organization that secures appointing of independent arbitrator who shall proceed the dispute resolution process in accordance with rules of the organization. In a contract between parties, the agrrement on such arbitration is usually established in an arbitration clause.

Arbitration court of the Czech Republic - Arbitrážní soud České republiky, o.s. (ASCR) is an association of experienced lawyers and experts on arbitration proceedings. ASCR secures whole arbitration proceeding between parties to a dispute by its arbitrators.

Advantages of arbitration with ASCR arbitrators are:
- quick proceeding (an executable resolution is issued within 4 - 8 weeks usually)
- lower administrative fees (3 % instead of 4 % required by general courts)
- easily distrainable in Czech Republic (an arbitrator’s resolution has the same power as court’s judgement)
- easily distrainable in abroad under Convention on the Recognition and Enforcement of Foreign Arbitral Awards - the "New York" Convention

To utilize ASCR arbitrator, the following arbitration clause shall be a part of a contract between the parties:

All disputes arising out of or under this contract shall be settled by binding arbitration by an arbitrator appointed by Arbitrážní soud České republiky, o.s., residing at Prague, in accordance with its rules as available at www.rozhodcidolozka.cz.
